“Personal Information” includes but is not limited to information that tells us specifically who You are, such as Your name, phone number, email, address, and possibly information relating to certain support or customer service issues.

Submission of User Generated Content

We collect information that You voluntarily provide as part of our Website and Services, such as your Personal Information and any other information You submit through the Website and Services, (“User Generated Content”). Resuscio may in Resuscio’s sole discretion share Your User Generated Content with other users. • The disclosure is to financial service providers in order to fulfill and carry out the services requested by You;

• The disclosure is permitted by relevant law;

• The Personal Information to be disclosed is otherwise publicly available in accordance with the applicable law;

• The disclosure is reasonably related to the sale or other disposition of all or part of our business or assets;

• The disclosure is for Resuscio’s own marketing purposes or, with Your authorization, for the marketing purposes of third parties;

• The disclosure is combined with information collected from other companies and used to improve and personalize services, content, and advertising from us or third parties;

• The party to whom the disclosure is made controls, is controlled by, or is under common control with Resuscio;

• The disclosure is in Resuscio’s sole discretion necessary for the establishment or maintenance of legal claims or legal compliance, to satisfy any law, regulation, subpoena or government request, or in connection with litigation;

• The disclosure is in Resuscio’s sole discretion about users who Resuscio believes are engaged in illegal activities or are otherwise in violation of the Resuscio Operating Agreement and other Resuscio agreements, even without a subpoena, warrant or court order; or

• The disclosure is to outside businesses to perform certain services for us, such as maintaining our Website and Services, mailing lists, processing orders and delivering products and services, sending postal mail, processing claims for lost or stolen certificates, providing marketing assistance, confirming Your identity for review integrity, and data analysis (“Administrative Service Providers”), including Administrative Service Providers outside the country or jurisdiction in which You reside.

Prior to sharing of Your Personal Information with others, agreements are made between Resuscio and such outside parties to whom we are transferring data to provide for the allowable use and security of the transferred information in accordance with this Privacy Policy and any applicable law. If Resuscio becomes aware that any such outside party is improperly using or disclosing Personal Information, we will notify that outside party and request that it take reasonable steps to cease such use or disclosure. We may provide certain Personal Information as a service to others for their marketing purposes. We may also disclose Your name and address to Service Providers when You submit User Generated Content relating to those Service Providers. If You properly notify us that You no longer want us to share Your Personal Information, we will stop sharing Your Personal Information. However, except as otherwise stated in this Privacy Policy, we do not directly control the third parties to which we share such Personal Information, and You will need to further notify such third parties directly if You would like them to stop use of Your Personal Information.

YOUR CHOICES AND ACCESS TO YOUR INFORMATION

You have the right to access and control the personal information that we collect about you. Please note that we may need to verify your identity before fulfilling your request. 

You can also ask us whether we are keeping information about You; ask how Your information is being used; ask us to update or correct Your information; or opt-out of our collection and use of certain information by sending an email to support@resusc.io or by writing us at the address listed at the bottom of this Privacy Policy, specifying the nature and scope of Your request. If You choose to opt-out of the collection and use of certain information, You understand that some services, may no longer be available to You, potentially requiring the cancelation of Your Membership. We may require proof of Your identity before we provide You with the requested information.

DATA SECURITY, INTEGRITY, AND ACCESS

The Personal Information You provide and Resuscio collects is stored within databases that Resuscio controls directly or through Resuscio’s Administrative Service Providers. As Resuscio deems necessary and as required by the applicable law, Resuscio uses security measures appropriate for the sensitivity of the Personal Information and consistent with industry standards, including physical, organizational, and technological protections, such as, but not limited to, firewalls and encryption technology to protect Your Personal Information, and password information. However, since no security system is impenetrable, Resuscio cannot guarantee the security of Resuscio’s databases, and cannot guarantee that information You supply will not be intercepted while being transmitted to Resuscio over the Internet. Personal Information may only be accessed by persons within Resuscio, Resuscio’s third party service providers who require such access to provide You with the services indicated above, or any other party that You have provided us with authorization to share such information with. We retain Personal Information that we collect only if reasonably necessary to fulfill the purposes for which it was collected or to otherwise meet any legal requirements. Your information may be transferred to, and maintained on, computers located outside of Your state, province/territory, or country where the privacy laws may not be as protective as those where You live. If You are located outside the United States and choose to provide information to us, please be aware that we transfer Personal Information to the United States and process and store it there. Resuscio does not control such other websites and is not responsible for their content, their privacy policies, or their use of Personal Information. Resuscio’s inclusion of such links does not, by itself, imply any endorsement of the content on such websites or of their owners or operators except as disclosed on the Website and Services. Any information submitted by You directly to these third parties is subject to that third party’s privacy policy.

CHILDREN'S PRIVACY

Resuscio does not intend the Website and Services to be used by individuals under the age of majority within the jurisdiction within which they reside without the supervision of a parent or guardian of majority age. Resuscio relies upon such parents or guardians to determine if the Website and Services are appropriate for the viewing, access, or participation by such individuals under the age of majority. If an individual under the age of majority uses the Website and Services, such individual may only use the Website and Services under the supervision of a parent or guardian of majority age.

We do not seek or knowingly collect any Personal Information about children under thirteen (13) years of age. If we become aware that we have unknowingly collected Personal Information from a child under the age of thirteen (13), we will make commercially reasonable efforts to delete such information from our database.

If You are the parent or guardian of a minor child who has provided us with Personal Information, You may contact us using the information below to request it be deleted.

CALIFORNIA RESIDENTS’ PRIVACY RIGHTS

This Privacy Policy describes how we may share Your information for marketing purposes. If You are a California resident, California law may provide You with additional rights regarding our use of Your Personal Information. California residents may request a list of any Personal Information provided to third parties in the preceding year for direct-marketing purposes. EUROPEAN UNION (“EU”) RESIDENTS’ PRIVACY RIGHTS

This Privacy Policy describes how we may share and process Your information for marketing purposes. If You are a resident of the EU, the General Data Protection Regulation (“GDPR”) provides You with additional rights regarding our use of Your Personal Information. This Privacy Policy follows the regulations of the GDPR, which addresses the transfer of Personal Information outside of the EU and the European Economic Area (“EEA”) when services are offered.

You are explicitly and unambiguously consenting to the terms of this Privacy Policy prior to providing any of Your Personal Information to the Website. Under the application of EU regulations, You have the following rights in respect of your Personal Information:

• To restrict processing of Your Personal Information where: (i) the accuracy of the Personal Information is contested; (ii) the processing is unlawful but You object to the erasure of the Personal Information (iii) Resuscio no longer requires the Personal Information for the purposes for which it was collected, but it is required for the establishment, exercise or defense of a legal claim or (iv) You have objected to Resuscio processing Your Personal Information based on our legitimate interests and Resuscio is considering Your objection;

• Where You have provided Your Personal Information to Resuscio with Your consent, You have the right to ask Resuscio for a copy of Your Personal Information in a structured format and to ask Resuscio to share this data to another data controller, if You request;

• To obtain a copy of or access to safeguards under which Your Personal Information is transferred outside of the EEA; and

• You have the right to challenge and vocalize a complaint with a supervisory authority for data protection.

Resuscio may ask You for additional data to confirm Your identity and for other security purposes, before disclosing data requested by You. Resuscio reserves the right to charge a fee, where permitted by law. Resuscio will decline to process requests that jeopardize the privacy of others, are extremely impractical, or would cause Resuscio to take any action that is not permissible under applicable laws. Additionally, as permitted by applicable laws, Resuscio will retain where necessary certain Personal Information for a limited period for record-keeping, accounting and fraud prevention purposes.

UNITED KINGDOM (“UK”) RESIDENTS’ PRIVACY POLICY RIGHTS

This Privacy Policy describes how we may share and process Your information for marketing purposes. If You are a resident of the UK, the Data Protection Act 2018 (“DPA 2018”) applies to You and provides You with additional rights regarding our use of Your Personal Information. This Privacy Policy follows the DPA 2018, which controls how Your Personal Information is used by organizations, businesses and/or the government.

• The Personal Information is adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;

The DPA 2018 is heavily tailored by the terms of the GDPR. The DPA 2018 applies to the types of processing data to which the GDPR utilizes and should be read as a supplement to the GDPR.

CANADIAN RESIDENTS’ PRIVACY POLICY RIGHTS

This Privacy Policy describes how we may share and process Your information for marketing purposes. If You are a resident of Canada, the Office of the Privacy Commissioner of Canada provides You with additional rights regarding our use of Your Personal Information. This Privacy Policy follows the regulations of the Personal Information Protection and Electronic Documents Act (“PIPEDA”), which sets out the ground rules for how businesses subject to the law must handle personal information in the course of commercial activities.

Resuscio collects Personal Information automatically through the electronic means that are referenced in this Privacy Policy. Resuscio indicates to Users that they can disable cookies and/or web beacons to prevent further data collection, unless such technology is deemed necessary for the electronic platform to properly function.

MEXICAN RESIDENTS’ PRIVACY POLICY

This Privacy Policy describes how we may share and process Your information for marketing purposes.
